Which national DPIA lists already catch AI.

Under Art. 35(4) GDPR each supervisory authority publishes the processing that always needs a data protection impact assessment. This page reads the 18 lists in the EDPB register in full for what AI systems typically do (named AI, automated decisions, profiling or scoring, biometrics, employee monitoring, large-scale monitoring) and marks where an item overlaps an EU AI Act Annex III high-risk area.

Idea: Aurélie Pols Research and data: Jorge García Aibar

Where the lists come from

A controller carries out a DPIA before processing that is likely to result in a high risk to people's rights and freedoms, in particular when it uses new technologies (Art. 35(1)) 1. Three cases always need one: a systematic and extensive evaluation of personal aspects based on automated processing, including profiling, on which decisions with legal or similarly significant effects are based; large-scale processing of special categories of data or of criminal-conviction data; and large-scale systematic monitoring of a publicly accessible area (Art. 35(3)) 1. Each supervisory authority then publishes a list of the kinds of processing that always need a DPIA in its territory (Art. 35(4)), and may publish a list of those that never do (Art. 35(5)) 1.

The lists build on the nine criteria of the WP248 rev.01 guidelines: evaluation or scoring; automated decisions with legal or similarly significant effect; systematic monitoring; sensitive or highly personal data; large-scale processing; matching or combining datasets; vulnerable data subjects; innovative use of new technological or organisational solutions; and processing that prevents people from exercising a right or using a service or contract. Processing that meets two or more generally needs a DPIA 2.

How the EU AI Act points back to the DPIA

Art. 26(9) of the AI Act ties a deployer's DPIA to the provider's instructions 3:

"Where applicable, deployers of high-risk AI systems shall use the information provided under Article 13 of this Regulation to comply with their obligation to carry out a data protection impact assessment under Article 35 of Regulation (EU) 2016/679 or Article 27 of Directive (EU) 2016/680."

Art. 27(4), as replaced by the Digital Omnibus, lets the fundamental rights impact assessment (FRIA) reuse the DPIA instead of repeating it 36:

"If any of the obligations laid down in this Article is already met through the data protection impact assessment conducted pursuant to Article 35 of Regulation (EU) 2016/679 or Article 27 of Directive (EU) 2016/680, the deployer may, when conducting the fundamental rights impact assessment referred to in paragraph 1 of this Article, include cross-references to the relevant sections of that data protection impact assessment or include relevant parts thereof in the fundamental rights impact assessment."

The 2024 text said instead that the FRIA "shall complement" the DPIA; the consolidated text of 27 July 2026 carries the wording above, and the same amending act moved the application of Arts. 26 and 27 for Annex III systems to 2 December 2027 36. Where a national list already makes a DPIA mandatory for an Annex III use, the FRIA can point to that record. To build both from one record, see the impact-assessment builder and the FRIA-as-Code pattern.

The 18 lists

One row per list in the EDPB register, by country. "Yes" means at least one item of the list covers the topic (for "AI named", that the list uses the words); the items are below. The register holds each list in English; the national original is linked where it was found.

Annex III overlaps, list by list Each dot counts the items of a national list that overlap an EU AI Act Annex III area. The bars above total them per area; the Total column counts each list's overlapping items once, so an item that touches two areas sits in both columns but once in its total. Where a list already makes a DPIA mandatory for an Annex III use, the fundamental rights impact assessment can point to that record.

What the lists show

  • 7 of 18 lists name AI: Czech Republic, Germany, Greece, Italy, Liechtenstein, Poland and United Kingdom. Counting only the versions in the EDPB register, 6 do: Liechtenstein's register version says "deep learning", and its national version of 2020 adds "Künstliche Intelligenz". Only Germany makes the use of AI a trigger on its own (item 11); in the other lists AI is an example of new technology or of scoring, or one level of a scored criterion.
  • 18 cover biometrics, 18 profiling or scoring, and 17 automated decisions (not Finland): the processing behind Annex III points 1 and 5 was a DPIA trigger years before the AI Act. 14 cover employee monitoring.
  • By item count, the most frequent Annex III overlap is employment and workers’ management: 13 lists, 19 items. Then biometrics (16 lists, 17 items), essential private and public services (11 lists, 17 items), education and vocational training (2 lists, 2 items) and law enforcement (2 lists, 2 items). No item overlaps critical infrastructure, migration, asylum and border control or administration of justice and democratic processes.
  • The lists predate the AI Act. They were adopted between 10 Oct 2018 (Bulgaria) and 29 Aug 2019 (Iceland), years before Regulation (EU) 2024/1689. Only 2 lists show a dated change after 2019: Czech Republic (Jan 2020) and Liechtenstein (6 Aug 2020); see their notes below.
  • The EDPB adopted 22 opinions on draft lists on 25 September 2018 57 and 31 Art. 35(4) opinions in all, into 2019 7, but its register holds 18 lists 4, including the EEA states Iceland and Liechtenstein. Austria, Belgium, Malta, the Netherlands, Portugal, Romania, Slovakia and Sweden had a 2018 opinion and have no list in the register. Each number is right for its own source and date.
  • 14 lists enumerate processing types, 3 score criteria (a DPIA follows from how many are met) and 1 mixes both. Together they hold 215 items or criteria, 134 of them on what AI systems do.

The items, list by list

Each list's items on AI or algorithms, automated decisions, profiling or scoring, biometrics, employee monitoring, large-scale monitoring or new technology, with the item number as the list prints it, the list's own wording and our summary. An Annex III overlap is marked only where the item names a use inside the area.

Bulgaria Commission for Personal Data Protection

Enumerated list, 8 items, adopted 10 Oct 2018.

  • Item 1

Large-scale, non-sporadic processing of biometric data for unique identification.

Мащабно обработване на биометрични данни за целите на уникалната идентификация на физическо лице, което не е спорадично.

    • Biometrics

Annex III overlap: 1. Biometrics. Annex III point 1(a) where an AI remote biometric identification system is used.

  • Item 2

Genetic data processed for profiling with legal or similarly significant effects.

Обработване на генетични данни с цел профилиране, което поражда правни последици за субекта на данни или по подобен начин го засяга в значителна степен.

    • Profiling or scoring
    • Automated decisions
    • Health data
  • Item 3

Location data processed for profiling with legal or similarly significant effects.

Обработване на данни за местоположение с цел профилиране, което поражда правни последици за субекта на данни или по подобен начин го засяга в значителна степен.

    • Profiling or scoring
    • Automated decisions
    • Large-scale monitoring
  • Item 7

Children's data in information-society services offered directly to a child.

Обработване на лични данни на деца при пряко предлагане на услуги на информационното общество.

    • Children
  • Item 8

Migration of data from existing to new technologies linked to large-scale processing.

Осъществяване на миграция на данни от съществуващи към нови технологии, когато това е свързано с мащабно обработване на данни.

    • New technology

Czech Republic Office for Personal Data Protection

Scored criteria, 10 items, adopted 8 Feb 2019. A scored methodology, not an enumerated list: a DPIA is required when two characteristics reach the critical level, or one does and five reach the significant level. Republished in January 2020 with the Art. 35(5) list; the characteristic headings are unchanged.

  • Item 8 (8.1)

Characteristic 8, processing in technically complex or advanced infrastructures or platforms. Its highest (critical, red) level is 'automated expert systems including artificial intelligence' (systems for analysis and profiling).

Zpracování osobních údajů v technologicky složitých nebo pokročilých infrastrukturách nebo platformách; 8.1 Automatizované expertní systémy, včetně umělé inteligence

    • AI named
    • Profiling or scoring
    • New technology
  • Item 6 (6.1)

Characteristic 6, processing the data subject cannot influence. The critical level covers processing the data subject cannot influence, typically processing on a legal basis or resulting from automated decision-making.

Zpracování osobních údajů s omezeným ovlivněním subjekty údajů; 6.1 Subjektem údajů neovlivnitelné zpracování a předání

    • Automated decisions
